Terms and conditions

Please read these Terms of Use carefully as they govern your use of our online service ("the service"). We provide the service only on these terms and if you do not agree to be bound by them you may not use the service.

We care very much about the standard of the service, and we want to hear from you if you are not satisfied in any way. Please send your comments to [email protected]. “Asia Research News is the trading name of ResearchSEA Limited, registered with company number 5192797 in England and Wales. The registered office is at Lakin Rose Limited, Pioneer House, Vision Park, Histon, Cambridge, Cambridgeshire, CB24 9NL.

1. Your obligations to us

You agree to provide accurate and complete information to us when using the service. You agree that you will comply with any reasonable instructions issued by us from time to time concerning your access to the service and that you will only use the service in a manner consistent with these terms. You agree that you will not use the service for any unlawful purpose or in breach of any applicable law or regulation. In particular, you will not use the service to commit any criminal act or any act constituting infringement of any intellectual property right, or to transmit any material that is blasphemous, obscene, indecent or pornographic or which is of a defamatory, offensive, abusive, or menacing character or which may cause annoyance, inconvenience or needless anxiety to any person. We reserve the right to remove any material from the service which we at our sole discretion find objectionable. This may include the posting of any inaccurate information. We reserve the right to end your access to the service at any time in our absolute discretion. You agree to indemnify us against all losses (including, without limitation, legal costs) we may incur as a result of any breach by you of these terms. We may also take all or any of the following actions:

a. immediate, temporary or permanent withdrawal of your right to use our site;

b. immediate, temporary or permanent removal of any posting or material uploaded by you to our site;

c. issue a warning to you;

d. legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from your breach;

e. further legal action against you;

f. disclosure of such information to law enforcement authorities as we reasonably feel is necessary.

2. Our obligations to you.

We will provide the service to you with reasonable care and skill. However, we cannot guarantee that the service will be continuous or error free. We do not accept liability for any special loss or any indirect or consequential loss of any nature (including without limitation any economic loss or other loss of business, production, revenue, profit, goodwill or anticipated savings), whether arising in contract, tort, negligence, breach of statutory duty or otherwise, and whether or not the possibility of such loss arising has been brought to our attention.

We take no responsibility for material that has not been introduced by us. You acknowledge that you are solely responsible for the form, content and accuracy of any material introduced by you.

3. User Registration

Users are encouraged to register with us through the Join Page.

There are 4 types of registration – Researcher, Institution, Journalist and General Subscriber.

All users regardless of registration type must take reasonable steps to ensure that your personal username and password are not used by anyone else.

Researcher

Researchers may create a profile page that highlights relevant information about their research, post events that they are organizing that are of interest to the research community, and jobs within their company, unit, lab and/or department relevant to the research community. Your institution may invite you to be listed as an Expert on their Institution page on our website and journalists may contact you if they would like more information about your research or your expertise. You may opt not to be contacted by journalists. Other users may contact you via an online form. Registration of researcher accounts is subject to our approval. You will be required to produce satisfactory evidence of your appointment and qualifications. Researchers must comply with all general terms of service, and not abuse their posting privileges, or risk losing access to the site.

Journalist

Journalists may register to access embargoed press releases and contact researchers who have agreed to be contacted by journalists. Journalists are welcome to use press releases with proper attribution to the source institution and Asia Research News. Registered journalists must comply with the embargo conditions and not release the story until the embargo has expired. Any user breaking embargoes will lose access to the site. Registration of journalist accounts is subject our approval. You will be required to produce satisfactory evidence of your journalistic qualification and you warrant that all information provided by you for the purpose of registering with us is accurate and complete. Journalists must comply with all general terms of service, and not abuse their privileges, or risk losing access to the site.

Institutions

Institutions may register to list their Institutions and may choose to upgrade to Premium membership. Users registering an Institution warrant that you have permission to register on behalf of your institution and that all information provided by you is accurate and complete. Institutions choosing to upgrade to Premium must complete the payment before access to Premium membership is granted. Users registering as Institutions must comply with all general terms of service, and not abuse their posting privileges, or risk losing access to the site.

Institutions with premium memberships will be able to post information like press releases, events and jobs. Posts by Premium Institutions will go live immediately. Please ensure all information is accurate before posting. We reserve the right to delete any content that does not meet our requirements. Additionally, Institutions can choose registered researchers to be your Institution’s Experts or invite your key researchers to register for an account.

The lead manager of the Institution account/page may appoint and register additional Institution users from your staff at your Institution. Please ensure you trust the staff to have complete access to the Institution page and other postings (such as press releases, jobs, events). Asia Research News is not responsible for any errors or damage caused by the user. All users must comply with all general terms of service, and not abuse their posting privileges, or risk losing access to the site.

General subscriber

You may register to receive email alerts of the latest news, events, jobs and other information posted on the website. Content on our website is welcomed to be shared with proper attribution to the source Institution and Asia Research News.

4. Submission of information

For all content submitted, you authorise us in our discretion to edit and take extracts from the content of the material; to publish, reproduce, translate, distribute, display and store the material throughout the world; and to authorise others to do so; and you accept that we have the right in our discretion to exclude any material from our site. You warrant that:

a. you have explicit permission and authority to submit the content upon these terms;

b. you or your Institution owns the copyright of the submitted material and has licensed us to publish and distribute the information;

c. if the work or material of others is included in the submitted materials, you have obtained the necessary consent and copyright permission for use and distribution by us.

5. Disclaimer

You use this service at your own risk. The service is provided as is and without warranties of any kind either expressed or implied. We disclaim all warranties of merchantability and fitness for a particular purpose to the fullest extent permissible. We do not warrant or make any representations regarding the use of or the result of the use of the material in this service in terms of its correctness, accuracy, reliability, or otherwise.

6. Your Personal Data

We will be what is known as the “Controller” of the personal data you provide to us. We will comply with all the legal obligations on us in relation to your personal data. We collect the following information:

1. Individual information from public, researchers, Institutions and journalists .

2. Aggregated statistics, which we use to monitor the overall activity of the website.

3. Information provided during submission of content

Some information from the registration form may be displayed in the public area of the site and used for our marketing purposes. No other third parties have access to your personal data (unless the law allows them to do so or unless we have your consent to such access). If at any point you wish to have access to this personal data or believe the information we process on you is incorrect or incomplete you can request to see this information and have it corrected or deleted. You also have the right to restrict our processing of your personal data or to object to our processing of it. You can withdraw your consent at any time, but this may affect our ability to provide the service. If you wish to raise a complaint on how we have handled your personal data, you can contact our Data Protection Officer who will investigate the matter. If you are not satisfied with our response or believe we are processing your personal data not in accordance with the law you can complain to the Information Commissioner’s Office (ICO).

7. General

7.1 Neither party shall be liable for any delay or default in performing any of its obligations if the delay or default results from events or circumstances outside its reasonable control.

7.2 This Agreement constitutes the entire agreement between the parties concerning its subject matter and supersedes any previous understanding or agreement, express or implied.

7.3 No forbearance or delay or any party in enforcing its right will prejudice or restrict the rights of that party and no waiver of any such rights or of any breach of any contractual terms will be deemed to be a waiver of any other right or any later breach.

7.4 A person who is not a party to this Agreement may not enforce any of its terms under the Contracts (Rights of Third Parties) Act 1999.

7.5 We reserve the right at any time, in our sole discretion, to make any changes to these Terms. Any changes will be notified to you by publishing the revised Terms on this site. By continuing to use the service you agree to be bound by such changes.

7.6 These Terms are to be interpreted in accordance with English law and, in the event of any dispute, you and we irrevocably submit to the non-exclusive jurisdiction of the English Courts.

7.7 Finally, nothing in these Terms of Use is to be interpreted as an attempt to limit or exclude our liability for any personal injury resulting from our negligence, and if you are a consumer, nothing we say affects your statutory rights.
